Information on the Right of Withdrawal

Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.)

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

• on which you, or a third party designated by you who is not the carrier, take possession of the goods, provided that you have ordered one or more goods as part of a single order and the goods are delivered together;
• on which you, or a third party designated by you who is not the carrier, take possession of the last goods, provided that you have ordered several goods as part of a single order and the goods are delivered separately;
• on which you, or a third party designated by you who is not the carrier, take possession of the last partial shipment or the last item, provided that you have ordered goods that are delivered in several partial shipments or items;

To exercise your right of withdrawal, you must inform us (Hamburger Tauwerk Fabrik GmbH & Co. KG, Schützenstr. 107 / Tor 1, 22761 Hamburg, Telephone: (+49) 40 36807980, E-mail address: info(@)htf-hh.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online using a correspondingly labelled button ("Withdraw from Contract" or a similar designation) on our website (www.hamburgertauwerk.de). If you use this online function, we will immediately send you an acknowledgement of receipt on a durable medium (e.g. by e-mail), containing information about the content of your withdrawal statement as well as the date and time it was received. You may also complete and submit the model withdrawal form or another clear statement electronically on our website (www.hamburgertauwerk.de/). If you make use of this option, we will immediately send you (e.g. by e-mail) confirmation of receipt of such a withdrawal.

To comply with the withdrawal period, it is sufficient that you send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of additional costs resulting from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement for goods that can be shipped as a parcel until we have received the goods back or until you have supplied evidence that you have sent the goods back, whichever is the earlier.

We will collect the goods that cannot be shipped as a parcel.

You must return or hand over the goods that can be shipped as a parcel to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods that can be shipped as a parcel before the period of 14 days has expired.

You shall bear the direct costs of returning goods that can be shipped as a parcel as well as the direct costs of returning goods that cannot be shipped as a parcel. The costs for goods that cannot be shipped as a parcel are estimated at a maximum of approximately EUR 299.

You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Return Shipping Costs

If you exercise your right of withdrawal, you shall bear the costs of returning the goods.

For returns within Germany, we provide you with a DHL return label via our returns portal – either as a QR code or for printing. If you use this label, we will deduct a flat fee of EUR 5.95 from your refund. This flat fee applies exclusively to returns from Germany. 

Alternatively, you may return the goods to us at your own expense using a shipping service provider of your choice. 

For returns from abroad, please contact us in advance; we will then clarify the shipping method and costs with you individually. Our returns portal is not available for this purpose. 

If the goods were delivered incorrectly or are defective, we will bear the return shipping costs.

Exclusions and Reasons for Expiry

The right of withdrawal does not apply to contracts

• for the supply of goods that are liable to deteriorate rapidly or whose expiry date would be rapidly exceeded;
• for the supply of alcoholic beverages, the price of which was agreed at the time of conclusion of the contract, but which can only be delivered at least 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;
• for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts. The right of withdrawal expires prematurely in the case of contracts * for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery;
• for the supply of goods which, after delivery, have become inseparably mixed with other goods due to their nature;
• for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
